How to Buy and Sell Real Estate by Power of Attorney

You live in another city or abroad and want to buy or sell a parcel in Kandıra, but you cannot come for the title deed transactions. In this case a power of attorney comes into play: you can complete the deed transactions through a representative to whom you have given the authority to act on your behalf.

What Is a Power of Attorney?

A power of attorney is the official document showing that one person has given another the authority to carry out certain legal transactions on their behalf. For land registry transactions such as buying and selling real estate, the power of attorney must be drawn up in the form of a deed at the notary and must include a photograph. The type of transaction (sale, purchase, mortgage and so on) must be clearly stated in the power of attorney; for the sale of a property, the power of attorney is required to specifically state the authority to sell.

How Is It Drawn Up?

  • If you are in Türkiye: It is enough to apply to any notary with your ID and a passport-size photograph (for notary addresses, see the Union of Turkish Notaries). Also keep the ID details of the person you will authorise as representative with you; the representative does not need to be present at the notary.
  • If you are abroad: You can have a power of attorney drawn up at the Republic of Türkiye consulate in the country where you are. Consular powers of attorney are directly valid in Türkiye. For powers of attorney drawn up at foreign notaries, an apostille and a sworn translation are required.

Which Authorities Should Be Granted?

The scope of the power of attorney is set according to need: limited authority can be given for the sale of only a particular parcel, or a broader set of authorities covering purchase, sale, fee payment, and municipal and land registry transactions can be defined. Our recommendation: keeping the authority as specific to the transaction as possible — for example, limiting it to the sale of the property whose block/parcel number is stated — is the soundest course for the safety of both you and the other party.

Security: What Should You Pay Attention To?

  • Know the person to whom you will grant the power of attorney; if you are working with an institutional counterpart, let the process and responsibilities be in writing.
  • Do not keep the scope and duration of the power of attorney broader than necessary; once the matter is done, you can revoke it at the notary.
  • Let the method of paying the sale price (bank channel, blocked payment and so on) become clear before the transaction; the price changing hands at the same time as the deed transfer is the safest method.
