What Is the Title Deed Fee and How Is It Calculated?

The title deed fee is an official charge collected by the state during real estate purchase and sale transactions. It must be paid before a sale, transfer or change of ownership can be completed. Whether the property is land, a field, a home or a commercial unit, no deed transfer can take place without paying the title deed fee.

Who Pays the Title Deed Fee and How Much Is It?

Under the Turkish Fees Law No. 492, the title deed fee is collected separately from the buyer and the seller:

  • Buyer: 2% of the sale price
  • Seller: 2% of the sale price

So the title deed fee comes to a total of 4% of the property's sale price.

Important: The fee is calculated on the sale price declared at the land registry, but this figure cannot be lower than the property's official assessed value. Declaring below the real sale price can later lead to the fee being collected with a penalty.

A Worked Example

For a property with a declared sale price of 500,000 TL at the land registry:

  • Fee collected from the buyer: 500,000 TL × 2% = 10,000 TL
  • Fee collected from the seller: 500,000 TL × 2% = 10,000 TL
  • Total title deed fee: 20,000 TL

These amounts are paid before the deed transfer, and the transaction is then completed.

When and How Is the Fee Paid?

Once the land registry appointment is booked, the registry office issues the payment details; the fee can then be paid through tax offices, partner banks or e-Devlet. The deed transfer does not take place until payment is made.

Who Pays the Title Deed Fee?

By law the fee is collected separately from the buyer and the seller. In practice, however, the parties may agree between themselves that the whole fee will be paid by either the buyer or the seller; this does not affect the validity of the transaction.

What Costs Are There Besides the Fee?

In addition to the fee, a fixed revolving fund charge is collected for each transaction, and its amount is set anew every year.
