
How to Buy and Sell Real Estate with a Power of Attorney
You live in another city or abroad and want to buy or sell a parcel in Kandıra, but you have no opportunity to come for the title deed procedures. In this situation, a power of attorney comes into play: you can complete the title deed procedures through a proxy whom you authorise to act on your behalf.
What Is a Power of Attorney?
A power of attorney is an official document showing that one person grants another the authority to carry out certain legal transactions on their behalf. For transactions to be carried out at the land registry, such as the purchase and sale of real estate, the power of attorney must be drawn up at a notary and include a photograph. The type of transaction (sale, purchase, mortgage, etc.) must be clearly stated in the power of attorney; in a power of attorney granted for the sale of a property, the authority to sell must be specifically written out.
How Is It Drawn Up?
- If you are in Türkiye: It is sufficient to apply to any notary with your identity document and a passport-sized photograph (for notary addresses, see the Union of Turkish Notaries). Also keep with you the identity details of the person you will authorise as proxy; the proxy does not need to be present at the notary.
- If you are abroad: You can have a power of attorney drawn up at the Turkish consulate in the country where you are located. Consular powers of attorney are directly valid in Türkiye. For powers of attorney drawn up at foreign notaries, an apostille and a sworn translation are required.
Which Powers Should Be Granted?
The scope of the power of attorney is determined according to need: limited authority can be granted solely for the sale of a specific parcel, or a broader set of powers covering purchase, sale, payment of fees, and municipal and land registry procedures can be defined. Our recommendation: Keeping the authority as transaction-specific as possible — for example, limiting it to the sale of the property whose block/parcel number is specified — is the most sensible route for the security of both you and the other party.
Security: What Should You Watch Out For?
- Know the person to whom you will grant the power of attorney; if you are working with a corporate counterpart, let the process and responsibilities be put in writing.
- Do not keep the scope and duration of the power of attorney broader than necessary; once the matter is concluded, you can revoke the power of attorney at the notary.
- Let the method of payment of the sale price (bank channel, blocked payment, etc.) be clarified before the transaction; the price changing hands simultaneously with the title deed transfer is the safest method.
